Just received an interesting request from Mortgage Guaranty Insurance Corporation on a tax return I prepared in 2006.

Question #1:Is the information on the return correct

Question #2:Did I complete the return

This request came with a permission signed by client. I certainly prepared return, but as to "correct". Define correct, it is correct based on information provided, but I didn't audit client information to make sure it was accurate, which in my mind means correct.

Should I sign or tell the guy I'm not the IRS

This is what I would tell the company:

The return was prepared based on information provided by the taxpayer.

I suggest you call your insurance provider prior to answering any questions. Any answer should have the standard clauses regarding "underwriting must rely on own work", Information provided by client was not verified nor audited", and "response should not be used in any underwriting decision". Your insurance provider may want to add more protective clauses.

By the way, did the request meet all the specific items required by the IRS this year? If not, it is not valid.

I would not answer any such requests.

The mortgage industry screwed up and is looking to you for a fix.

I don't believe you are under any obligation to answer.

Naturally, I suggest you talk to your attorney.

You also have those disclosure laws to worry about.
