Hey WD,
I'm not surprised that you don't get anywhere with a tax administrator. Generally all they can do is apply the law as she is writ, and it is a waste of time to raise constitutional issues with them. I'm impressed that she took the time to give you a response that at least sounds thoughtful (even if wrong <G>).

Hi William,
Thank you for your recent response to my tax forum question. But I have to admit I got a bit lost - I am sorry - you took so much time to compose an answer to my post and very detailed - I appreciate that!!! So if I understood your post, I believe you are saying technically the way the IRS rules are written, I would still need to include the 1099-G state tax refund in 2009 income, even after amending the 2008 to NOT take the state income tax deduction, but rather take the sales tax deduction that year? Further, if I understood you correctly, the way the IRS treats this is not correct, from a logical standpoint, and that one solution I could use is to disclose the position in the return and not include the 1099-G in his 2009 income?

MD nonresident return
Hey, WD, thanks so much for following up on that! The same question has come up over on misc.taxes.moderated. I'm traveling (need to get out of here right now!) and don't have time to go through your information in detail, but I really appreciate your efforts. I knew the result you get from the form (turning non-MD source losses into MD source income) couldn't possibly be right.
